General Terms and Conditions of Sale of the Association Mer et Rencontres
1. Booking
Any booking will only become effective after receipt by the Association Mer et Rencontres of a validated purchase order bearing the signature and official stamp of the organisation, or after payment for the service.
2. Prices
The price is set definitively on the day of booking. It is established in euros, including all taxes, according to the services booked and the number of participants.
3. Payment terms
Only bookings paid by cheque, bank transfer, bank card, online payment or holiday vouchers before the deadline stated on the purchase order will be validated.
4. Booking confirmation
Upon receipt of payment, A.M.E.R. will send a booking confirmation containing all the information required for the proper organisation of the booked services.
5. Sessions and schedules
Land sailing sessions are supervised by state-qualified instructors holding the BEES 1° diploma. In accordance with the recommendations of the Fédération Française de Char à Voile, instructors may supervise a maximum of 12 people.
Participants are asked to arrive 15 minutes before the start of the session. In order for the activity to take place in the best possible conditions, the activity will not be provided in the event of a delay of more than 30 minutes and will be invoiced in full.
6. Modifications
Modification requested by the client
Any modification to the initial booking, such as a reduction in the number of participants or a change of time or date, will only be accepted with the express agreement of A.M.E.R.
Administrative fees amounting to 10% of the order will be applied to the cost of the service.
The absence of a participant will only be taken into account for invoicing purposes at the discretion of A.M.E.R. and for duly justified legitimate reasons, such as a medical certificate.
Modification by the Association Mer et Rencontres
A.M.E.R. reserves the right to modify, if necessary, the conditions of execution of the booked activities, provided that this modification does not affect one of the essential elements of the contract.
If, before the start of the activities, an external event beyond A.M.E.R.’s control prevents the execution of an essential element of the booked activity, the client will be informed as soon as possible.
The client may either cancel the booking and receive a full refund of the sums paid, or accept the proposed modification and sign an amendment specifying the changes made and any resulting decrease or increase in price.
If, after the start of the activities, an external event beyond A.M.E.R.’s control prevents the execution of an essential element of the booked activity, the client will be informed and offered a postponement of the activities to a later date.
If A.M.E.R. is unable to offer a postponement solution, or if this solution is refused by the client, A.M.E.R. will refund the sums paid for the activities concerned.
7. Cancellation
Cancellation by the client
Any cancellation must be notified by registered letter, the postmark being taken as proof.
Cancellation less than 7 days before the service: 100% of the amount due.
Cancellation less than 30 days before the service: 75% of the amount due.
Cancellation less than 60 days before the service: 50% of the amount due.
Cancellation more than 60 days before the service: 25% of the amount due.
A late arrival or early departure will not give rise to any refund.
Cancellation by the Association Mer et Rencontres
In the event of cancellation by A.M.E.R. and in the absence of any fault on the part of the client, A.M.E.R. will refund the client the full amount paid, depending on the chosen formula. Reduced rates are non-refundable, whatever the reason.
A.M.E.R. undertakes to issue any refund within a maximum period of 20 working days.
For 2-hour sessions, any refund request must be sent to A.M.E.R. within a maximum period of one month after the date of the cancelled service.
After this period, the client will receive a credit note valid for 1 year.
The client may not claim any compensation if the cancellation is imposed by circumstances beyond A.M.E.R.’s control, force majeure, safety reasons or unfavourable weather conditions.
A.M.E.R. also reserves the right to remove any person whose conduct or actions would disrupt the proper running of a service. Such a measure will not give rise to any refund.
8. Liability and insurance
Client liability
The client is personally responsible for all damage, loss or deterioration caused by them, by their agents, by persons under their authority or by items under their care.
The client must also ensure that each participant has taken out civil liability insurance for any damage they may cause. The client will bear the consequences in the event of any failure in this respect towards A.M.E.R.
Liability of the Association Mer et Rencontres
A.M.E.R. has taken out professional civil liability insurance with AXA, the insurer of the FFCV to which the association is affiliated: AXA Agency, Julien Vidal, 34 avenue Georges Pompidou, 31270 Cugnaux.
A specific information notice setting out the covered guarantee thresholds is available on request.
This civil liability insurance covers the participant if they injure someone or unintentionally cause material damage to sports facilities and equipment.
However, it does not cover the participant’s bodily injury or damage caused to their equipment. Participants are advised to check with their insurer that they have taken out individual accident insurance.
Under no circumstances can A.M.E.R. be held liable in the event of loss or theft of items belonging to the client or participants.
9. Complaints
All complaints relating to the conditions under which the booked services were carried out must be sent by registered letter to A.M.E.R. no later than 7 days after the end of the service.
Failing this, the services as a whole will be considered to have taken place under satisfactory conditions.
